France's Higher Tribunal Increases Prison Term for Gisele Pelicot Perpetrator

A defendant was declared guilty on appeal of sexually assaulting Gisele Pelicot following she was rendered comatose by her husband – and received his jail term extended to a decade.

Dogan, forty-four, an unemployed builder, who had appealed his first conviction last year, underwent a appeal hearing this week at the higher court in Nîmes.

Gisèle Pelicot, who was cheered upon exiting the courtroom each day by supporters present to back her, said to the defendant in court: “You haven’t understood. When are you going to recognise you assaulted me? It is illegal to assault an unconscious woman. How could I have give you permission? Never.”

The victim, 72, became an international feminist hero after she relinquished her right to confidentiality in the trial last year when she said: “Guilt ought to transfer.”

When Dogan was seventeen he was caught by authorities for dealing drugs and his father kicked him out of home. He spent time in prison for trafficking in his twenties and had worked as a laborer but had undergone periods of being unhoused.

He was married and had a child with a genetic condition, who he was the principal carer for, as his spouse worked in a school canteen. The court heard his spouse did not know he had regular intimate relations outside their marriage. His legal team said this was his way of coping with his stressful life. Dogan had informed a mental health expert that once a year he sought commercial sex on his birthday. His legal representatives informed the court he had arthritis triggered by the stress of the initial proceedings.
